1. Scope of application
The following General Terms and Conditions (GTC) apply to all orders placed via our website. The physical products offered on this website are only available to customers with a residential address in Switzerland. Digital products (print@home) offered on this website are available to customers with a residential address in Switzerland or abroad.
A customer is a natural person who has a business relationship with Waldhaus Hotel AG that cannot be attributed to their commercial or independent professional activity. Orders in quantities not normally associated with private households may be refused without any reason.
AG Hotel Waldhaus Sils reserves the right to amend these GTC at any time. The version of these GTC valid when the order is placed shall apply and cannot be changed unilaterally. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not be recognized.

3. Gift vouchers
With online gift vouchers, it is important to know that AG Hotel Waldhaus Sils sends them to their customers with a tamper-proof code. Although customers can print out the vouchers themselves, even multiple times, only the first printout with the valid code is redeemable and has value. The first redeemed voucher recorded in the Waldhaus voucher management system is considered the original and must be validated by AG Hotel Waldhaus Sils immediately upon redemption. If the same code is used more than once, this constitutes misuse and can be prosecuted. In this case, the customer has no claim to fulfillment or compensation by AG Hotel Waldhaus Sils, even if the original redeemer is not the rightful owner of the voucher. In addition, a criminal investigation may be launched against the person concerned for forgery of documents.
As vouchers can also be given away as a gift or passed on, AG Hotel Waldhaus Sils has no way of verifying the owner of the voucher. When a voucher is redeemed, it is only checked as to whether the voucher number is valid in the system and whether it has been paid for correctly.
Waldhaus vouchers are generally valid for two (2) years (see date and note on the voucher). After this period has expired, AG Hotel Waldhaus Sils is no longer obliged to accept the voucher. A lost voucher will not be replaced, and vouchers are not redeemable for cash. If the value of the voucher exceeds the cost of the service used, AG Hotel Waldhaus Sils will credit the remaining value in full against future visits or consumption. A cash payment of the remaining amount is not possible. AG Hotel Waldhaus Sils is not obliged to accept vouchers that have not yet been paid for as a means of payment. Early reservations are necessary for the services described in the vouchers, especially for vouchers for overnight stays or spa treatments.
4. Prices
The sales prices indicated on www.shop.waldhaus-sils.ch/en are final prices and, unless stated otherwise, include statutory value-added tax and any other statutory fees. The prices are quoted net in Swiss francs (CHF).
Unless stated otherwise, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.
Technical changes, errors and misprints are reserved; in particular, AG Hotel Waldhaus Sils may change prices at any time and without prior notice. Consulting and support services are not included in the sales prices.
5. Conclusion of contract
The products and prices on this website are non-binding offers.
By placing an order via this website, including acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. AG Hotel Waldhaus Sils then sends an automatic order confirmation by email, which confirms that they have received the customer’s order. Orders placed are binding for the customer.
The contract is concluded as soon as AG Hotel Waldhaus Sils sends a declaration of acceptance by email, in which the dispatch of the ordered products or services is confirmed.
Orders will only be delivered after full payment has been received and provided the goods are available. If the ordered goods cannot be delivered or not be delivered in full, AG Hotel Waldhaus Sils is entitled not to accept or only partially accept or execute the order. In such a case, AG Hotel Waldhaus Sils will inform the customer by email. If AG Hotel Waldhaus Sils has already received the customer’s payment, they will refund the payment to the customer. If the customer has not yet made a payment, the customer is released from the obligation to pay.

Deliveries are sent by the Swiss Post or courier service to the address specified by the customer in the order.
AG Hotel Waldhaus Sils endeavors to keep delivery times as short as possible. However, delivery times specified in the order confirmation are non-binding. AG Hotel Waldhaus Sils is entitled to make partial deliveries. In this case, the customer will only be charged once for the shipping costs.
If the delivery cannot be made or if the customer refuses to accept the delivery, AG Hotel Waldhaus Sils may terminate the contract after notifying the customer by email and granting a reasonable grace period, and may charge the customer for the costs of any inconvenience caused.
8. Right of cancellation
The customer has the right to cancel the order for ten (10) calendar days after receipt of the goods. The time limit is deemed to have been met if the customer sends a written cancelation by email or letter to AG Hotel Waldhaus Sils within this period.
The exercise of the right of cancellation leads to a reversal of the contract. The customer must return the goods within ten (10) calendar days in their original packaging, together with the delivery bill, to the return address specified by AG Hotel Waldhaus Sils. Returns to AG Hotel Waldhaus Sils are at the customer’s expense and risk. Any payment already made will be refunded to the customer within twenty (20) calendar days, provided that AG Hotel Waldhaus Sils has already received the returned goods.
9. Guarantee
AG Hotel Waldhaus Sils endeavors to deliver goods of impeccable quality. In the event of defects reported in good time, AG Hotel Waldhaus Sils guarantees freedom from defects and functionality of the item purchased by the customer for the statutory warranty period. At AG Hotel Waldhaus Sils’s discretion, it may honor the warranty by either means of a free replacement of equal value or by reimbursement of the purchase price. Further warranty rights are excluded.
The guarantee does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances.
AG Hotel Waldhaus Sils cannot give any assurances or guarantees for the topicality, completeness or correctness of the data or for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content. In particular, no assurance or guarantee is given that the use of the website will not infringe the rights of third parties that are not owned by AG Hotel Waldhaus Sils.
10. Liability
AG Hotel Waldhaus Sils excludes all liability, irrespective off its legal basis, as well as claims for damages against AG Hotel Waldhaus Sils and against any auxiliary persons and vicarious agents. In particular, AG Hotel Waldhaus Sils is not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the customer. A further compelling legal liability, for example for gross negligence or unlawful intent, remains reserved.
11. Data protection
AG Hotel Waldhaus Sils may process and use the data collected during conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes, taking into account the corresponding duty of care in dealing with sensitive customer data.

12. Partial invalidity
Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
13. Further provisions
AG Hotel Waldhaus Sils expressly reserves the right to amend these GTC at any time and to bring the amended GTC into force without prior notice.
Pace of jurisdication: Sils/Segl Maria, Switzerland is the exclusive place of jurisdiction for all disputes arising directly from the contractual relationship and including the General Terms and Conditions (GTC).
